Introduction

These Terms & Conditions ("Terms") govern your use of the services provided by Flexyble ("we", "us", or "our") through the Flexyble platform.

Flexyble provides a digital platform that connects qualified individuals with flexible work opportunities. Our service allows applicants to submit applications through joinflexyble.com, be evaluated for suitability, and receive notifications of available opportunities based on their profile and qualifications. Flexyble facilitates commission-based work opportunities where flex workers help businesses with sales, partnerships, and other professional services.

Definitions

"Flexi Worker" or "Flex Worker" means an individual who has been approved and accepted by Flexyble to provide flexible labor services on a project-by-project or assignment-by-assignment basis. Flex Workers are independent contractors who work on a commission basis and are not employees of Flexyble. Flex Workers do not receive employee benefits, paid leave, employment protections, or guaranteed work opportunities.

Acceptance of Terms

By accessing and using joinflexyble.com and submitting an application, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not use the Platform.

Important: These Terms of Service apply exclusively to the application website and portal (joinflexyble.com). Upon acceptance as a Flexi Worker (as defined above), you will be required to accept updated terms of service specific to your engagement as a flex worker. Those updated terms will supersede these application terms in their entirety.

Eligibility

Application Does Not Guarantee Acceptance

Submission of an application does not guarantee acceptance as a Flexi Worker. Eligibility is subject to Flexyble's sole determination based on:

  • Assessment of your qualifications, experience, and suitability
  • Verification of information provided in your application
  • Background checks and reference verification (where applicable)
  • Compliance with applicable legal requirements
  • Business needs and availability of opportunities

We reserve the right to reject any application at any time and for any reason, without notice or explanation.

Commission Structure

Commission-Based Compensation

All opportunities offered through Flexyble are provided on a commission basis only. Compensation is calculated based on booked revenue generated through completed work assignments.

For example, in sales development opportunities, you may receive:

  • Up to 50% of the monthly contract value for each sale you help facilitate
  • Commission payments carried for 6 months from the date of sale
  • A continued residual factor of 10% throughout the customer lifetime (subject to specific client terms)

Specific commission rates, payment terms, and structures vary by opportunity type and will be detailed in individual opportunity notifications. Commission structures are subject to change at any time at Flexyble's sole discretion. Changes will be communicated to active Flexi Workers and will apply prospectively to new opportunities.

Changes to Terms

Flexyble reserves the right to revise these Terms of Service at any time without prior notice. Continued use of the Platform following any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically for updates.

If you do not agree to any revised Terms, you must discontinue use of the Platform immediately.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FLEXYBLE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE PLATFORM, THESE TERMS, OR ANY OPPORTUNITIES, EVEN IF FLEXYBLE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FLEXYBLE'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR ANY INABILITY TO USE ANY PORTION OF THE PLATFORM, THESE TERMS, OR ANY OPPORTUNITIES SHALL NOT EXCEED THE AMOUNTS YOU HAVE PAID TO FLEXYBLE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR IF YOU HAVE NOT MADE ANY PAYMENTS, THEN FLEXYBLE'S LIABILITY SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100 USD) OR THE EQUIVALENT IN YOUR LOCAL CURRENCY.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
